This Privacy Policy for:
Emmett Motors (Rupanyup) Pty Ltd ABN 93 004 797 488 and each of its related bodies
corporate (collectively, the Emmett Group) describes how the Emmett Group seeks to comply with the Privacy
Act 1988 (Cth) and manages your personal information.
We collect personal information about customers, job applicants, staff members, contractors and other people
who come into contact with us (you).
By providing your personal information to us, you consent to the collection, use, disclosure, and storage of your
personal information as described in this Privacy Policy.
1. COLLECTION OF YOUR INFORMATION
(a) We only collect personal information necessary for one or more of our functions or activities.
(b) Without limitation, the types of personal information we collect may include:
(i) information collected from or relating to any John Deere products used by you,
whether provided by you directly via www.myjohndeere.com (MyJohnDeere) or
whether obtained automatically from any John Deere products (Machine Data).
Notwithstanding the foregoing, this Privacy Policy shall only apply to Machine Data to
the extent that such Machine Data includes personal information;
(ii) your contact information such as full name, e-mail address, address details and phone
numbers;
(iii) audio recordings of customer service or other calls with us (including your voice data);
(iv) details relating to your employment (if applicable) or your previous employment;
(v) your driver’s licence details;
(vi) your date of birth and proof of your date of birth;
(vii) photographs or video footage taken at our premises, which may include you;
(viii) if we are providing you with credit, credit application information (such as your
financial information, current and historical account information with us and credit
information (including credit scores and credit history)); and
(ix) if you are requesting products or services from us or we are purchasing goods or
services from you, any relevant payment or billing information (including without
limitation bank account details, direct debit, credit card details, billing address,
repayment information and invoice details).
(c) In limited circumstances, we may also collect sensitive information from you, including in
particular information (where relevant) relating to your criminal records, memberships of a
professional or trade association or trade union, religious beliefs or health information. We may
collect other types of sensitive information where you have consented and agree to the
collection of such sensitive information.
2 CAN YOU CHOOSE NOT TO DISCLOSE INFORMATION
(a) You decide how much personal information you wish to share with us and you may choose not
to provide personal information to us at any time (including not identifying yourself or using a
pseudonym).
(b) Some of the information we ask you to provide may be identified as mandatory or voluntary. If
you do not provide the mandatory personal information or any other information we require or if
you provide us with inaccurate or incorrect information, we may not be able to:
(i) provide our products or perform services that you have requested;
(ii) consider your application for employment with us; or
(iii) respond to your enquiry or request.
3. HOW WE COLLECT INFORMATION
(a) We collect your personal information when you:
(i) communicate with us by email, telephone (including where calls are recorded), in
person, or via our website or otherwise;
(ii) apply to work with us or are engaged by us as a contractor; and
(iii) use our websites, products and/or services.
(b) We also collect technical information, which is information from your computer, mobile phone,
tablets, and other devices and may include your IP address, cookie data, geolocation, date,
time, length, and pattern of use, operating system, model, and type of browser being used and
device settings.
(c) To the extent possible, we will collect your personal information directly from you or through
John Deere products used by you. Where we are providing products or services to you on
credit or where you apply for employment with us, we may collect personal information from
third parties (including without limitation banks, financial institutions, credit reporting bodies
(CRBs) or referees nominated by you) without further notice to you. If we otherwise collect
details about you from someone else, we will, whenever reasonably possible, make you aware
that we have done this and why.
4. PURPOSE OF COLLECTION, USE AND DISCLOSURE OF INFORMATION
We will only use or disclose your personal information for the primary purpose for which it was collected
(or a related purpose), including the following purposes or as otherwise consented to by you:(a) We collect
your personal information when you:
(a) providing and managing the delivery of our products and services, including processing orders
and delivering products;
(b) to arrange the provision of a third party's products and services to you, including without
limitation insurance, motor vehicle registration or finance;
(c) maintaining your access to and use of products including MyJohnDeere, including without
limitation using your personal information, including any Machine Data for remote display
access, wireless data transfer, soil and environment monitoring, analysis services, equipment
diagnostic, remote servicing or any other services provided via MyJohnDeere;
(d) if required, the verification of your identity, date of birth or contact details;
(e) in the case of potential employees, assessing your application for employment with us;
(f) if we are providing you (or an entity related to you) with credit, to assess your creditworthiness
(or the creditworthiness of your related entity which is receiving the credit);
(g) if we assist you with an application for credit with a third party credit provider, to submit your
credit application with the credit provider and to otherwise assist with the financing process;
(h) for our internal management purposes, to manage our relationship with you and to manage the
payment and recovery of amounts payable to us by you;
(i) the improvement of our products and services;
(j) the maintenance and development of our products and services, business systems, website
and infrastructure;
(k) co-ordinating, managing and maintaining good order and security of our staff, our premises and
other parties on our premises;
(l) investigating and reporting information to third parties regarding any accidents or incidents that
may have occurred on our premises;
(m) marketing and promotional activities by us and our related entities via any medium (including
by direct mail, telemarketing, email, SMS and MMS messages);
(n) sending you communications regarding product maintenance, availability, functionality, or other
matters;
(o) to provide customer service functions, including handling customer enquiries, complaints and
providing customer support;
(p) our compliance with applicable laws;
(q) the potential sale of our business or company to a third party; and
(r) any other purposes that are reasonably necessary in connection with our ordinary functions
and activities.
Sensitive personal information will only be used or disclosed by us for the primary purpose for which it
was collected (or a directly related purpose).
At times, we will use automated systems to support decision‑making and internal processes including in
relation to fulfilling orders, directing support requests and reviewing credit applications. This helps
improve efficiency and consistency in the delivery of goods and services to you, rather than determine
the outcome of any interaction with us. No final decisions in relation to our response to your support
requests or the outcome of a credit application will be made solely by automated means without human
oversight.
5. DISCLOSURE OF YOUR INFORMATION
We may disclose your personal information to the members of the Emmett Group and third parties in
connection with the purposes described in clause 4. These third parties include:
(a) John Deere Limited ABN 21 008 671 725 and its related bodies corporate, contractors, agents
or third party providers (John Deere Limited) (including its data hosting service providers, who
manage the infrastructure used to provide MyJohnDeere);
(b) John Deere Financial Limited ABN 55 078 714 646 and its related bodies corporate,
contractors, agents or third party providers;
(c) Collins Securities Pty Ltd trading as Express Fund ABN 30 004 400 597 and its related bodies
corporate, contractors, agents or third party providers;
(d) banking or financial institutions or CRBs that might be required for credit check or reporting
purposes;
(e) if we arrange for the supply of goods and services to you by third parties, those third party
suppliers;
(f) if you have provided us with referees to assist with a credit application, a job application or the
assessment of a potential contract between you and us, the referees you have provided;
(g) relevant third parties where you have nominated us as your referee;
(h) our service providers, contractors, and agents who assist us in providing our products and
services to you; and
(i) if required by law, regulatory or enforcement agencies.
If you fail to make a payment to us as and when due or commit a serious credit infringement we may
disclose details of those events to CRBs. A CRB may use such information in reports given to other
credit providers to help assess your creditworthiness. You have certain rights to request that CRBs do
not use or disclose credit reporting information about you if you believe on reasonable grounds you have
been or are likely to be a victim of fraud. You should contact each relevant CRB directly if you wish to
request this.
6. DIRECT MARKETING
We may use and disclose your personal information for the purpose of promoting our goods and/or
services to you, which can be delivered by a range of communications, including email, telephone, or
SMS. You may unsubscribe from our direct marketing communications at any time by using the
"unsubscribe" option included in the communication or by contacting us via the details set out in clause 12.
7. OVERSEAS DISCLOSURE
Any personal information provided to us may be:
(a) transferred to, and stored at, a destination outside Australia, including without limitation the
United States of America, Canada, the European Union (particularly Germany), India, Singapore
or New Zealand where we or John Deere Limited may utilise overseas data and website hosting
facilities or where we or John Deere Limited may have entered into contractual arrangements with
third party service providers to assist us, or John Deere Limited, with providing
MyJohnDeere or our goods and services to you; and
(b) processed by staff or by other third parties operating outside Australia who work for us, John
Deere Limited or for any suppliers, agents, partners or related companies of John Deere
Limited or the Emmett Group.
Except where an exception applies under the Privacy Act 1988 (Cth), we will take reasonable steps to
ensure that overseas recipients do not breach the Australian Privacy Principles.
8. HOW WE HOLD AND SECURE YOUR INFORMATION
(a) We may hold your personal information in either electronic or hard copy form or through third
party data storage providers. We take reasonable steps to protect your personal information
from misuse, interference and loss, as well as unauthorised access, modification or disclosure
and we use physical, administrative, personnel and technical measures to protect your personal
information.
(b) However you acknowledge that the security of personal information transmitted over the
internet cannot be guaranteed. Except to the extent liability cannot be excluded due to the
operation of statute, we exclude all liability for the consequences of any unauthorised access to,
disclosure of, misuse of, or loss or corruption of your personal information where we have
complied with our obligations to take reasonable steps to protect your personal information.
(c) Please notify us immediately of you become aware of any breach of security.
9. ACCESS TO AND CORRECTION OF YOUR INFORMATION
(a) If you would like to access the personal information we have about you, you can contact us via
the details set out in clause 12. Sometimes, we may not be able to provide you with access to
all of your personal information and, where this is the case, we will tell you why. We may also
need to verify your identity when you request your personal information. We reserve the right
to charge a fee for searching for and providing access to your information.
(b) If you think that any personal information we hold about you is inaccurate, please contact us
and we will take reasonable steps to ensure that it is corrected.
10. THIRD PARTY WEBSITES
Our website may redirect you to other websites that are operated by third parties. We strongly
recommend that you review these websites' separate privacy policies to understand how they will
collect, use, disclose, and hold your personal information.
11. CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify our Privacy Policy as our business needs require. We will notify you of
such changes either through direct communication or by posting a notice on our website. The revised
version of the Privacy Policy will be effective at the time we post it, after which, your continued use of
our products, services or website or your continued dealings with us will indicate your acceptance of the
modified terms.

with information about the further steps you can take.
